This Privacy Policy describes how PHYZIKA® ("we," "us," or "our") collects, uses, and discloses your personal data when you use our website and the choices you have associated with that data..

We process your personal data for statutory reasons, for the performance of a contract or on the basis of our legitimate interest. Processing for other purposes will be made only upon your express consent.

DEFINITIONS

E-store: online store operated by PHYZIKA®, available on www.phyzika.store;

GDPR: Regulation (EU) 2016/679 of the European Parliament and of the Council;

Order: a transaction completed by the customer by pressing the relevant “Buy” button;

Personal data: any information about the User, that may identify them, irrespective of the manner, including but not limited to: name, email address, shipping address, billing address, and payment information;

Processor: carries out personal data processing by virtue of a contract / other express authorization, in accordance with the applicable GDPR provisions;

Processing of personal data: any and all operation(s) involving Personal Data, with or without the application of automated algorithms, including but not limited to: organisation; assignment; storage, structuring, adaptation, disclosure by transmission / dissemination / other; restriction, anonymization; trend and other analysis; erasure or destruction.

User: natural person by whom Personal Data is input and relates to; generally the visitor to the website / customer at the electronic store.

1. Data we process, in what manner we collect it and how much time we keep it

• Personal Data: 
• name, surname, age, gender; 
• contact details (e-mail; delivery address); 
• billing and bank details, as well as any other details required for due and proper accounting of our business activities worldwide;
• comments written during the order process;
• any and all information you provide to us in the course of communication with us / our representatives / affiliates / order administrators; User’s account and behaviour (in particular the data filled in by the User, purchase history and preferences, time of registration, date of last profile update);
• the comments you add to our posts on social media (in particular Facebook, Instagram, YouTube, TikTok, LinkedIn), as well as your profile name (nickname) on these social media and the information you make publicly available on your social media profiles,
• IP address;

• Automatically Collected Data: We may automatically collect certain information about your device, including information about your web browser, IP address, time zone, and some of the cookies that are installed on your device.

2. How do we process and use your data?

2.1. Applicable periods:

• During the validity of the purchase contract and for the time it takes to carry out any and all obligations / rights, arising / granted by the contractual relationship between the User and us, including any claim management and dispute resolution activities, stemming from and in relation to said contract;
• During the time needed for us as a business to fulfil any and all pertaining legal obligations, stemming from the applicable law, from time to time;

Processing period for a User’s Personal Data shall be no longer than 5 years from said User’s last communication with us / our representative / affiliate / orders administrator or the express termination of the purchase contract on our behalf, unilaterally, or another period as per the applicable legislation / legally binding decision, issued by a competent authority. 

In some cases, User’s Personal Data may be processed for a period of up to 15 years after execution of the last purchase contract, if considered needed for protection of our legitimate interests.

2.2. Purposes for processing Personal Data:

2.2.1. Registration and setting up a User account with the website: You consent to providing Personal Data by setting up your User Account in the E-store and any future versions thereto. Registration of User Account is required in order to make purchases, place orders, and otherwise take full advantage of the website’s full functionalities.

2.2.3. Contract performance: Main statutory purpose for Personal Data processing is correct and timely performance of our obligations, stemming from the purchase contract, including administration of orders, etc.

The User acknowledges and consents that such policies may differ and are handled separately by each platform.

Communication with customer support: If enquiry has been directed to us via email, via our Contact form or via social media, we process any Personal Data provided for the purpose of dealing with the enquiry. User acknowledges and consents that, on our sole discretion, we may upload any and all enquiries we deem appropriate, to a public section of the website for the purposes of forming a pool of Frequently asked questions whose answers might benefit other Users/visitors to the website. 

2.2.9. Signing up for newsletter: If you sign up for our newsletter, you consent to receive specifically tailored for our users emails containing various information / promotions. If you no longer wish to receive such emails, click on the specified for this purpose link, included in each of our emails.

2.2.10. Reviews: You can share opinions on items and provide assessment in the Reviews section of our website. All feedback given in any form may also be processed.

2.2.11. Payment: Depending on the manner of payment, we may transfer bank card details for processing by designated secure recipients of such data, who carry out the payment process for us.

With service providers who assist us in operating our website and providing services to you: We only use verified Processors with whom we have a written contract and who provide us with at least the same guarantees as we provide to you. We have stated the specific Processors above.

4.2. With third-party advertising partners to deliver advertisements tailored to your interests: These may include analytics based tools being applied to your profile activities on our website.

4.3. With law enforcement or government authorities if required by law or to protect our rights, property, or safety: We may disclose personal data outside of listed herein Processors if required to do so by law or in response to lawful requests by public authorities, competent courts and/or legal representatives employed to protect our best interests within an ongoing litigation.

In order to do this, you may be required to contact us via the email listed below with an express request, which we will carry out as soon as possible. We may need to verify your identity in order to process your request.

Our website is not intended for individuals under the age of 18.
